Death should be democratic ”; These words were recently spoken by the French Alain Cocq, a terminal patient of a terrible illness that has him confined to bed and who has decided, due to the impediment of French legislation, to interrupt his vital treatment and broadcast his death live to generate reflection on the importance of recognizing direct euthanasia as a kind of dignified death. Costa Rica is not excluded from this, and has established through several jurisprudential votes that a dignified death is a right that every terminally ill person has, which is expressed in the fact of dying without pain, thereby recognizing the relevance of orthothanasia. but not of euthanasia, which he refutes with the argument that the modern character of Human Rights grants life a supreme character. This article intends for the reader to delve into this debate, by approaching various thematic axes: the rejection of therapeutic cruelty, the various meanings of the concept of dignified death, classification of euthanasia and its legal nature. Likewise, its development is condensed in the questioning of the supremacy of human life from its friction with the principle of dignity and its edges, and the coherence of the legal system. Although it does not seek to clarify all the doubts about euthanasia, if the reader ends up with more questions than answers, the objective will have been achieved, since it is left to free meditation to answer the title: Is death a democratic decision? “La base de una democracia es que los ciudadanos tengan libertad de elección. La muerte debería ser democrática”; estas palabras fueron dichas recientemente por el francés Alain Cocq, paciente terminal de una terrible enfermedad que lo tiene confinado a una cama y quien ha decidido, por impedimento de la legislación francesa, interrumpir su tratamiento vital y transmitir en vivo su muerte para generar reflexión sobre la importancia de reconocer la eutanasia directa como una especie de muerte digna. Costa Rica, no está al margen de ello, y ha establecido por medio de varios votos jurisprudenciales que la muerte digna es un derecho que tiene todo enfermo terminal que se expresa en el hecho de morir sin dolor, reconociendo con ello la relevancia de la ortotanasia más no de la eutanasia a la que refuta con el argumento de que el carácter moderno de los Derechos Humanos concede a la vida un carácter supremo. El presente artículo pretende que el lector se adentre en este debate, por medio del abordaje de diversos ejes temáticos: el rechazo del encarnizamiento terapéutico, las diversas acepciones del concepto de muerte digna, clasificación de la eutanasia y su naturaleza jurídica. Asimismo, se condensa su desarrollo en el cuestionamiento sobre la supremacía de la vida humana desde su roce con el principio de dignidad y sus aristas, y la coherencia del ordenamiento jurídico. Si bien no se persigue aclarar todas las dudas en torno a la eutanasia, sí el lector termina con más preguntas que respuestas, el objetivo habrá sido alcanzado, pues se deja a la libre meditación responder al título: ¿La muerte es una decisión democrática?
