The dynamics of participation has been understood as a struggle for the inclusion of vulnerable groups in the State, whose manifestations are linked strongly to the access to the property and housing. Social movements have emerged with the conviction that, based on participation, they have a historic window of opportunity to change the discriminatory and exclusionary rules. In this context, the irregular settlements constitute one of the best testimonies of the struggle for participation based on the property. The present study aims to describe the exclusionary practices arising from access to land since the formation of the State, and to demonstrate that, on the basis of the experience of the August 26 town, in Tarija, Bolivia, human rights are still subject to property titles. Los derechos de participación política en Bolivia han estado siempre subordinados a la tenencia de la tierra, ello ha provocado que hasta nuestros días la realización de los derechos humanos se encuentre determinada por la propiedad. Las dinámicas de participación se han entendido como una lucha por la inclusión de los grupos vulnerables en el Estado, cuyas manifestaciones se encuentran vinculadas fuertemente al acceso a la propiedad y la vivienda. Los movimientos sociales han emergido con el convencimiento de que se encuentran ante una oportunidad histórica para cambiar las reglas discriminatorias y excluyentes a partir de la participación. En este contexto los asentados irregulares constituyen uno de los mejores testimonios de la lucha por la participación a partir de la propiedad. El presente estudio tiene por objeto describir las prácticas excluyentes derivadas del acceso a la tierra desde la conformación del Estado y demostrar, a partir de las experiencias del barrio 26 de agosto de la ciudad de Tarija, que los derechos humanos se encuentran todavía subordinados a títulos propietarios. Os direitos de participação política na Bolívia foram sempre subordinados à posse da terra, provocando que até hoje os direitos humanos sejam determinados pela propriedade. As dinâmicas de participação foram compreendidas como uma luta pela inclusão do estado aos grupos vulneráveis, cujas manifestações estão fortemente ligados ao acesso à terra e vivenda. Os movimentos sociais surgiram com a convicção de estar enfrentando uma oportunidade histórica para mudar as regras de discriminação e exclusão através da participação. Neste contexto, os colonos irregulares representam um dos melhores testemunhos da luta pela participação a partir da propriedade. Este estudo tem como objetivo descrever as práticas de exclusão resultantes do acesso à terra, desde o estabelecimento do Estado e demonstrar, a partir das experiências do assentamento 26 de agosto, na cidade de Tarija, onde os direitos humanos ainda estão subordinados a títulos proprietários.
