The role of Universities in the 21st Century goes beyond simple teaching and research, in this context of globalization and technological revolution the Institutions of Higher Education have to foster innovation from the academy in order to become agents that promote the economic growth. Technology-based companies play an important role as they are born as a result of the scientific research carried out by teachers where the scientific and technological knowledge of the university is transferred to the new company in order to develop products or services that can meet the needs of the market, generating jobs and having a positive impact on the economic and social development of the countries. The object of study of this article is to analyze whether the national and institutional legal order of UNAN - León allows the creation of technology-based companies, characterize university professors and determine their possible participation in these companies. El rol de las Universidades en el Siglo XXI va más allá de la simple enseñanza e investigación, en este contexto de globalización y revolución tecnológica la Instituciones de Educación Superior tienen que fomentar la innovación desde la academia con la finalidad de convertirse en agentes que promueven el crecimiento económico. Las empresas de base tecnológica juegan un papel importante ya que nacen como resultado de la investigación científica realizada por docentes en donde se transfiere el conocimiento científico y tecnológico de la universidad a la nueva empresa con la finalidad de desarrollar productos o servicios que puedan satisfacer las necesidades del mercado, generando empleos e impactando de manera positiva en el desarrollo económico y social de los países. El objeto de estudio del presente artículo es analizar si el ordenamiento jurídico nacional e institucional de la UNAN – León permite la creación de empresas de base tecnológica, caracterizar a los docentes de la universidad y determinar su posible participación en dichas empresas.
