Los artículos 46 y 71 de la Constitución Política de Nicaragua establecen una serie de instrumentos internacionales en materia de derechos humanos el cual de ser considerados parte integral de nuestro ordenamiento jurídico significaría considerar que la sección dogmática de la constitución nicaragüense no se acota en ella misma, sino que continua en estos instrumentos internacionales y que por lo tanto una violación a estos tratados sería una violación directa a la propia constitución por lo que es importante definir que lugar ocupan estos tratados dentro de nuestro ordenamiento jurídico tomando en consideración nuestra jurisprudencia.
