But this reflection cannot be carried out outside the limits that this auxiliary discipline of criminal law imposes from the Constitution. The relationship between criminal policy and criminal law is extremely close, to the extent that criminal policy trends have an impact on the theoretical constructions made by criminal dogmatics. Objective: In this article and with special emphasis on the developments outlined by Salvadoran constitutional jurisprudence, we will study the limits that the criminal policy of a Democratic and Constitutional State of Law imposes on the exercise of punitive power, to prevent it from becoming arbitrary, despotic and unreasonable. Method: In order to study the different aspects of the topic, the qualitative method was implemented and the technique used was that of documentary information. To this end, the review of contemporary criminal doctrine, the Constitution, constitutional and criminal jurisprudence and the Inter-American Court of Human Rights demonstrate the importance of the punitive power of the State having clearly established limits.   Results: From the study of the limits to the exercise of the punitive power of the State that the Criminal Policy imposes from the Constitution, it is clear that in the current times where the fashion is the “flight” to criminal law or punitive populism, respect for the rights and guarantees of the person, must be more effective than ever.  It is up to academics, judges, defense lawyers, prosecutors, to be the first barrier or containment when this punitive power overflows, is exceeded and becomes the first response given by the State to the various social problems it experiences day by day in its bosom. Introducción: Siempre resulta importante realizar un abordaje del papel que desempeña la política criminal en nuestros días. Pero esa reflexión no puede realizarse al margen de los límites que dicha disciplina auxiliar del Derecho penal impone desde la Constitución. La relación que existe entre la política criminal y el Derecho penal es sumamente cercana, al grado de que las tendencias político criminales tienen incidencia en las construcciones teóricas que realiza la dogmática penal. Objetivo: En este artículo y con especial énfasis en los desarrollos esbozados por la jurisprudencia constitucional salvadoreña, se estudiará los límites que la política criminal de un Estado Democrático y Constitucional de Derecho impone al ejercicio del poder punitivo, para evitar que este se vuelva arbitrario, despótico e irrazonable. Método: Para estudiar las diferentes aristas del tema se implementó el método cualitativo y la técnica que se utilizó es el de información documental. Para ello, la revisión de la doctrina penal contemporánea, la Constitución, jurisprudencia constitucional, penal y de la Corte Interamericana de Derechos Humanos demuestran la importancia de que el poder punitivo del Estado tenga límites claramente fijados. Resultados: Del estudio de los límites al ejercicio del poder punitivo del Estado que la Política Criminal impone desde la Constitución, deja entrever que en los momentos actuales donde la moda es la “huida” al Derecho penal o el populismo punitivo, el respeto a los derechos y garantías de la persona deben estar más vigentes que nunca. Corresponde a los académicos, jueces, abogados defensores, agentes fiscales, ser la primer barrera o contención cuando ese poder punitivo se desborde, se exceda y se vuelva en la primera respuesta que otorgue el Estado ante los distintos problemas sociales que experimenta día a día en su seno.   Universidad de El Salvador.
