RDMCP626262024-11-04T20:43:24Z THE TREATMENT OF ERROR IN CRIMES OF OMISSION LA CUESTIÓN DEL ERROR EN LOS DELITOS DE OMISIÓN Tavares, Juarez The article addresses the treatment of error in crimes of omission, from the perspective of a performative action, in order to take into account the empirical and normative relationships that support the criminal types. Unlike commission crimes, which are usually seen from the angle of a relationship between means and end, omissive crimes, which previously link the conduct to a duty to act, but which must be configured on a causal relationship, by imposition of the Criminal Code itself, imply another structure for errors of type and prohibition under the assumption of an explanation of causal dogmatics. In view of this, it can be said that this error is not simply an error of type or prohibition, but an error of wrongfulness. El artículo aborda el tratamiento del error en los delitos de omisión, desde la perspectiva de una acción performativa, con el fin de tener en cuenta las relaciones empíricas y normativas que sostienen los tipos penales. A diferencia de los delitos comisivos, que suelen verse desde el ángulo de una relación entre medio y fin, los delitos omisivos, que previamente vinculan la conducta a un deber de actuar, pero que deben configurarse sobre una relación causal, por imposición del propio Código Penal, implican otra estructura para los errores de tipo y de prohibición bajo el supuesto de una explicación propia de la dogmática causal. A la vista de ello, puede decirse que este error no es simplemente un error de tipo o de prohibición, sino un error de injusto.
