spelling	RDMCP574102023-11-01T16:44:43Z CASSATION REVIEW OF THE REASONING OF THE JUDGMENT EL CONTROL DE LA CASACIÓN SOBRE LA MOTIVACIÓN DEL FALLO Zamora Acevedo, Miguel The investigation analyzes the problem related to the criminal challenge adopted in the admissibility phase of the criminal appeal, specifically on the non-observance or erroneous application of a legal, substantive or procedural precept. This, due to possible errors in the assessment of the evidence and determination of the factual premise. As a first problem, the dichotomy between the principle of immediacy and the need to review the ruling is addressed, pointing out the absence of contradiction in the analysis of evidentiary inferences in accordance with current procedural rules. Next, and as a second point, the relationship between the facts and the law is studied, pointing out the necessary link, which is affected by the design of the rules for admission of the appeal. From the above, making a reconstruction of the evidentiary reasoning used, it is shown that the review in cassation of issues related to the fact-law binomial is a requirement that arises from the need to review the ruling. La investigación analiza la problemática relativa a la impugnación penal adoptada en la fase de admisibilidad del recurso de casación penal, específicamente sobre la inobservancia o aplicación errónea de un precepto legal, sustantivo o procesal. Ello, en razón de posibles errores en la valoración de la prueba y determinación de la premisa fáctica. Como primer problema se aborda la dicotomía entre el principio de inmediación y la necesidad de revisión del fallo, señalando la inexistencia  de contradicción en el análisis de las inferencias probatorias conforme a las reglas procesales vigentes. De seguido, y como segundo punto, se estudia la relación entre los hechos y el derecho, señalando el vínculo necesario, el cual se ve afectado, por el diseño de las reglas de admisión del recurso. A partir de lo anterior, haciendo una reconstrucción del razonamiento probatorio empleado, se muestra que la revisión en casación de las cuestiones relacionadas con el binomio hechos-derecho es una exigencia que surge de la necesidad de revisión del fallo, así como el resguardo al derecho de la prueba.
