The intention of this text is not only to show the dominant position of our Third Chamber of the Supreme Court of Justice, but to determine if birth as a differentiating criterion is enough to clarify the obscures that revolve around the issue: when the product of pregnancy dies inside the uterus; define it was a fetus o well a person protected by the criminal offense of homicide. El principio de la vida humana es un tema transcendental que permite reglar cuándo el ser humano es un sujeto de tutela jurídica en nuestro ordenamiento, pues existen diversas tesis que valoran de manera distinta el inicio de la vida humana y por lo tanto la noción de persona. La pretensión de este texto, no es solo mostrar la postura dominante de nuestra Sala Tercera de la Corte Suprema de Justicia, sino determinar, si el nacimiento como criterio diferenciador, es suficiente para esclarecer los oscuros que giran en torno al tema: cuando el producto de la gestación muere dentro del seno materno; definir si se trataba de un feto o bien de un individuo protegido por el tipo penal del homicidio.
