Argüello Quesada, Carmen This research presents a critical reflection that aims to awaken in the reader, a new notion of guilt based on neuroscience and its contributions to legal science. It is analyzed, the legal framework, the criteria of free will, its scope and the current approach and the new developments in other countries, which have ratified judgments regarding the scientific evidence and the extension of its use, in the jurisprudence of the comparative law. In addition, the brain of psychopaths and violent people was analyzed, to try to present the transversal axes, around the anomalies that criminals present, to be able to demonstrate, the scope of neuroscience and how this knowledge represents a point of inflection that encourages a debate on a new form to reproach with a more human and comprehensive view of the environment of the accused. We developed a qualitative design to show cases around the compared law, presenting explanations of the psychopathy condition and violence, in criminal cases and the evidence for the diagnosis of psychopathy. The analysis of the information supports the medical diagnosis, and the repercussions in the judicial verdict regarding the legal responsibility. We analyzed the biological explanation of psychopathy and violence compared to neurological evidence. The dilemma between the culpability, free will, and the novel knowledge of neuroscience, propose the possibility to reduce the sentence term or the effect of mitigation based on the neuroscience evidence. La presente investigación, plantea una reflexión crítica que pretende despertar en el lector, una nueva noción de la culpabilidad a partir de la neurociencia y sus aportes a la ciencia jurídica. Se somete a un análisis, el abordaje jurídico internacional, el criterio de libre albedrío, sus alcances y las tendencias en otros países, que han ratificado sentencias en torno a la evidencia científica y la extensión de su uso en la jurisprudencia del derecho comparado. Seguidamente, se analiza el cerebro de los psicópatas y personas violentas, para intentar presentar los ejes transversales, en torno a las anomalías de estos sujetos y con ellas, los alcances de la neurociencia y cómo este saber representa un punto de inflexión que propicia un debate, sobre una nueva forma de reproche, con una mirada más humana y comprensiva del entorno de los imputados. Se desarrolló una metodología cualitativa, para mostrar casos que han presentado evidencias acerca de la condición de psicopatía y violencia en casos penales, para fundamentar el criterio de culpabilidad. El análisis de la información sustentada en el diagnóstico médico, ha repercutido en el veredicto judicial, en cuanto a la responsabilidad legal y su uso para futuros planteamientos en el derecho local. Analizamos la explicación biológica de la psicopatía y la violencia en comparación con la evidencia neurológica. El dilema entre la culpabilidad, el libre albedrío y el conocimiento novedoso de la neurociencia, proponen la posibilidad de reducir el plazo de la sentencia o el efecto de mitigación, con base en la evidencia de la neurociencia.
