Legislation and medical and legal practice in Costa Rica have opted for the first one, however, the protection of human rights has evolved, generating significant changes, one of which has undoubtedly been the technical standard for the medical procedure related to article 121 of the Criminal Code. Vivimos en un período de constantes cambios paradigmáticos que ponen en la palestra temas de gran relevancia como el aborto, últimamente controvertido debido a las diversas líneas de pensamiento, agrupadas en dos grandes categorías, conservadora, con marcados tientes de moralidad, y feminista, que reclama el derecho de la mujer a la disposición de su cuerpo. La legislación y la práctica médica y jurídica en Costa Rica se han decantado por la primera de ellas; sin embargo, la tutela de los derechos humanos ha venido evolucionando, generando cambios significativos, uno de ellos ha sido sin duda la norma técnica para el procedimiento médico vinculado con el artículo 121 del Código Penal.
