spelling RDMCP379342019-07-02T08:00:12Z THE STATE’S RESPONSIBILITY FOR PREVENTIVE DETENTION IN THE INTERNATIONAL HUMAN RIGHTS LAW LA RESPONSABILIDAD DEL ESTADO POR PRISIÓN PREVENTIVA EN EL DERECHO INTERNACIONAL DE LOS DERECHOS HUMANOS Rojas Barrientos, Gabriel This paper develops the criteria that are observed in the International Law of Human Rights in relation to the responsibility of the State when a person is subjected to preventive detention, and then the prosecution process determines a dismissal or acquittal in their favor. Thus, according to an adequate understanding of the principle of presumption of innocence, it has been determined that the preventive prisoner, who is later acquitted, is entitled to compensation for the time he was deprived of his liberty.           This prevailing criterion in the International Human Rights Systems contradicts the current normative regulation of Costa Rica, which violates the principle of presumption of innocence by distinguishing between an innocence for certainty and for doubt when determining the right to receive compensation.                Therefore, through an adequate exercise of conventionality control, Costa Rica must adjust its domestic law to international regulations on this matter. El presente trabajo desarrolla los criterios que se observan en el Derecho Internacional de los Derechos Humanos en relación con la responsabilidad del Estado cuando una persona es sometida a prisión preventiva, y luego en el proceso penal se determinar un sobreseimiento o absolutoria en su favor. Así pues, de acuerdo a un adecuado entendimiento del principio de presunción de inocencia, se ha determinado que el preso preventivo, que luego es absuelto, es merecedor de una indemnización por el tiempo en que estuvo privado de libertad. Dicho criterio imperante en los Sistemas Internacionales de Derechos Humanos contradice la actual regulación normativa de Costa Rica, la cual quebranta el principio de presunción de inocencia al distinguir entre una inocencia por certeza y por duda a la hora de determinar el derecho a recibir una indemnización. Por ello, mediante un adecuado ejercicio del control de convencionalidad, Costa Rica debe ajustar su derecho interno a las regulaciones internacionales sobre esta materia.
