LOS DESTINOS DEL JUICIO ORAL EN LOS TIEMPOS ACTUALES Rivero García, Danilo fase preparatoria juicio oral prueba sentencia tribunal El sumario o expediente de fase preparatoria sigue teniendo una influencia en Cuba en el juicio oral y en la sentencia. Uno de los problemas es la lectura que hacen los jueces de la investigación. Es frecuente que se confronte al testigo con las declaraciones que dio en la fase sumarial o que se le indique simplemente si ratifica lo dicho en la fase investigativa. De lege ferenda los jueces deben estar menos comprometidos con la acusación y debe restarse la importancia que tiene el sumario en el dictado de la sentencia. Esto es importante tomarlo en cuenta en el proceso de reforma procesal que está siendo impulsado en Cuba.
