It also intends to demonstrate the control from the State exercised over women and families who had difficulties complying with the obligations set by legislation with regards to children’s care. In the end, the Costa Rican judges legitimized their influence on the population by assigning children taken from their parents to persons of the same economic, political and social levels. Qualitative analysis of files of the Police and Juzgado Primero del Crimen province of San José found in the Archivo Nacional del Costa Rica (ANCR) was used. One of the conclusions reached by the work is that the State controlled the parents by giving them obligations over their children and also controlled the women by assigning them socially assigned functions. The above exposed them to even greater social control and vigilance. El objetivo central de este artículo consiste en evidenciar la interiorización de la legislación sobre el abandono de niños y niñas en la población costarricense. También pretende demostrar el control que ejerció el Estado sobre las mujeres y familias que tuvieron dificultades para cumplir con lo que decía la legislación sobre sus obligaciones con la niñez. Finalmente, los juzgados costarricenses legitimaron su influencia sobre la población asignando los niños y niñas que se arrebataban a sus madres a personas de su mismo entorno económico, político y social. Se utilizó el análisis cualitativo de expedientes del fondo Policía y Juzgado Primero del Crimen de la provincia de San José encontrados en el Archivo Nacional de Costa Rica (ANCR). Una de las conclusiones a las que llega el trabajo es que el Estado controló a los padres dándoles obligaciones sobre sus proles y también controló a las mujeres asignándoles funciones tradicionales que les eran dadas socialmente. Lo anterior las expuso a un control social y vigilancia aún mayor.
