The purpose of this study is to analyze social representations of members of the legal system about human rights of international immigrants arrived to Argentina in the second half of 20th century. A qualitative methodological strategy was implemented; semistructured interviews to members of the legal institution of Buenos Aires metropolitan area were used. The interviews were transcribed and processed with qualitative criteria by implementing the Strauss and Corbin's (2002) methodology. This article analyses two relevant dimensions: citizens’ rights and migration policies. Among the main findings in the discourse of the subjects interviewed, it can be said that negative social representations about foreign people and their arrival to the country prevail. Even though there is a gradient of opinions whose extremes meet. On the one hand, there are those affirming equality (formal) in the access to all rights for native and migrant population. On the other hand, there are those who propose the priority of access to these rights for native subjects. The principle of universality from a human rights perspective is dwarfed when compared to the position of those who consider the migration control, the restriction of the arrival of migrants, and the closure of national borders as essential El objetivo del estudio ha sido analizar las representaciones sociales de miembros del sistema judicial acerca de los derechos humanos de migrantes internacionales que llegaron a Argentina a partir de la segunda mitad del siglo XX. La estrategia metodológica empleada ha sido de carácter cualitativa, se realizaron entrevistas semiestructuradas a miembros de la institución judicial del área metropolitana de Buenos Aires. Las entrevistas fueron desgrabadas de manera textual y, luego, procesadas con criterios cualitativos, siguiendo la metodología de Strauss y Corbin (2002). En el presente artículo se analizan dos relevantes dimensiones: los derechos ciudadanos y las políticas migratorias. Entre los principales hallazgos se puede afirmar que prevalecen, en el discurso de los sujetos entrevistados, representaciones sociales negativas acerca de las personas extranjeras y su llegada al país. Si bien existe un gradiente de opiniones, en cuyos extremos se encuentran, por un lado, quienes sostienen la igualdad (formal) en el acceso a todos los derechos entre la población nativa y migrante y; por el otro, quienes plantean la prioridad en el acceso de los sujetos nativos a dichos derechos; la idea de universalidad, propia de una perspectiva de derechos humanos, se ve eclipsada frente a la posición de quienes consideran imprescindible el control de las migraciones, la restricción de la llegada de migrantes y el cierre de las fronteras nacionales. O objetivo deste estudo foi analisar as representações sociais dos membros do judiciário sobre os direitos humanos dos imigrantes internacionais, que chegaram na Argentina a partir da segunda metade do século XX. A estratégia metodológica utilizada foi de caráter qualitativo, através de entrevistas semi estruturadas aos membros da instituição judicial da área metropolitana de Buenos Aires. As entrevistas foram gravadas na íntegra e, em seguida, processadas com critérios qualitativos, seguindo a metodologia de Strauss e Corbin (2002). Neste artigo analisar-se-a duas dimensões importantes: os direitos dos cidadãos e as políticas migratórias. Entre as principais conclusões, pode-se dizer que prevalecem no discurso das pessoas entrevistadas, representações sociais negativas sobre os estrangeiros e sua chegada ao país. Embora haja uma diferença de opiniões, cujos extremos são, por um lado, os que argumentam igualdade (formalmente) no acesso de todos os direitos entre as populações nativas e os imigrantes, por outro lado, aqueles que consideram que as pessoas nativas de cada região tem um acesso prioritário a tais direitos, a ideia de universalidade, própria da perspectiva dos direitos humanos, é eclipsada pela posição daqueles que consideram como essenciais o controle da migração, restringindo a chegada de imigrantes e ao fechamento das fronteiras nacionais.
