Migrant workers’ human rights have been brought to the current scope of public law, and their labor character has been prioritized. This movement for migrant workers’ human rights can be highlighted from the perspective of the entry into force of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, on 1 July 2003. In this document, two international regulatory texts are merged to strengthen the enjoyment of those rights in these groups of migrant workers: ILO Declaration on Fundamental Principles and Rights at Work and the Universal Declaration of Human Rights. Los derechos humanos de las personas trabajadoras migrantes han sido llevados al ámbito vigente del derecho público, y se ha priorizando su carácter laboral. Este movimiento en pro de los derechos humanos de migrantes podemos evidenciarlo a partir de la entrada en vigor de la Convención Internacional sobre la Protección de los Derechos de Todos los Trabajadores Migrantes y sus Familias el 1 de julio de 2003, documento donde se plasman y fusionan dos cuerpos normativos internacionales, los derechos laborales de la OIT y los derechos humanos de la ONU, para fortalecer la vigencia de tales derechos en estos grupos trabajadores migrantes. Os direitos humanos das pessoas trabalhadoras imigrantes foram levados no âmbito do direito público em vigor, e tem vindo a dar prioridade às questões trabalhistas. Este movimento a favor dos direitos humanos de imigrantes começou quando entrou em vigor a Convenção Internacional sobre a Proteção dos Direitos de Todos os Trabalhadores Imigrantes e dos Membros de Suas Famílias, em 1 de Julho de 2003, documento em que unem dois órgãos reguladores internacionais, os direitos trabalhistas da OIT e os direitos humanos da ONU a fim de fortalecer o exercício efetivo desses direitos para os grupos de trabalhadores imigrantes.
