El presente artículo tiene la finalidad de reflexionar si la costumbre como fuente del derechoen México, puede ser aplicada en razón al principio propersona cuando esta otorgue una protecciónmás amplia frente a la legislación, que ha sido por excelencia la fuente preponderanteen los países de tradición civilista.Se estudia, de forma breve, el concepto de costumbre y sus elementos, el reconocimiento dederechos de los pueblos indígenas en la Constitución mexicana, la justicia y tribunales autóctonos,el principio propersona como elemento de interpretación utilizado por los juzgadores ylas conclusiones. Para el desarrollo de este artículo el penúltimo tema es el de mayor relevancia.AbstractThis study aims to make the reader ponder whether custom, as a right source in Mexico may beapplied to the pro homine principle only when this provides a more expanded protection compare tothe legislation, which has been by far the major source in countries with civil tradition.
