El derecho humano a la educación es una de las mayores herramientas que los estados tienenpara logar el desarrollo integral de los pueblos, siendo validado por las naciones que integranla Organización de las Naciones Unidas. Pero no basta con ratificar este tratado, es necesarioevaluar el cumplimiento del mismo desde el análisis de la realidad educativa. Por tanto, esteensayo describe desde lo escrito y constitutivo, lo que es el derecho humano a la educacióny las implicaciones que dicho derecho conlleva; contrastando lo escrito con la realidades delejercicio de dicho derecho en Guatemala. Para revelar la situación educativa guatemalteca, sepresentan algunos datos generales y actuales sobre el tema educativo; también se realiza unabreve descripción de la educación bilingüe intercultural; además de describir la situación juvenilfrente al tema educativo en Guatemala. Por medio de este estudio, se denota la incongruenciaexistente entre lo promulgado en la declaratoria de los derechos humanos y la ConstituciónPolítica de la República de Guatemala; frente a la realidad educativa en Guatemala.AbstractThe human right to education is one of the greatest tools states have to achieve the integral development ofpeoples, validated by the nations that make up the organization of the united nations. But it is not enough toratify this treaty, it is necessary to assess its compliance thereof, establishing what is written, what the humanright to education is and the implications that right entails by means of contrasting the writing with the realitiesof the exercise of this right in Guatemala. To reveal the educational situation in Guatemala, some generalinformation on current education issues ere brought to consideration, as well as a brief description of interculturalbilingual education. In addition, the situation faced by youth in the educational system in Guatemala isdescribed. Through this study, the incongruity between what happened in the declaration of human rights andpolitical constitution of the Republic of Guatemala is noted and compare to the Guatemalan educational reality.Keywordshuman right to education, Guatemala; intercultural bilingual education; youth and education.
