DERECHOSHUMANOS57952019-10-11T22:55:19Z RECONSTRUCCIÓN DE LAS ESTRATEGIAS UTILIZADAS PARA MEJORAR LA PROTECCIÓN DE LA FAMILIA Garrido Gómez, María Isabel Cuenca Gómez, Patricia La Spina, Encarnación Pintocó Novales, Teresa Sánchez Martíinez, Olga Solanes Corella, Ángeles Familia políticas públicas mujeres niños El presente trabajo, realizado dentro del Proyecto Consolider-Ingenio 2010 “El tiempo de los derechos” (CSD2008-00007) y del Proyecto del Plan Nacional I + D + i “Derechos humanos, sociedades multiculturales y conflictos” (DER 2012-31771) ambos del Ministerio de Economía y Competitividad de España, pretende dar cuenta de la situación actual de las estrategias existentes para proteger a la familia en sus distintas vertientes, analizando cuáles son sus fortalezas y cuáles sus debilidades. En conjunto se da cuenta de que la familia se muestra como creadora de necesidades, simultáneamente, que las satisface junto al Estado y el sector privado. La investigación pone de manifiesto también que existen herramientas de protección de la familia más específicas que responden a problemas concretos, a título de ejemplo, unas se refieren a la protección del derecho a la reagrupación familiar y otras a la protección de la mujer y de la infancia en el contexto familiar. Por último, en lo que corresponde a la protección de la mujer y de la infancia en el contexto familiar, la primera es estudiada en cuanto que en el seno de la familia existen problemas añadidos que subrayan su situación de desigualdad y de mayor vulnerabilidad que el hombre. Y en lo atinente a los niños, la protección reconocida tiene que capacitarlos para autogestionarse y autodeterminarse responsablemente, pero la liberalización de las condiciones del divorcio y un aumento de controles en las relaciones entre padres e hijos en las familias posdivorcio pueden tener consecuencias negativas para los hijos.This paper seeks to explain the current status of existing strategies to protect the family in its various aspects, analyzing which are their strengths and which are their weaknesses. Overall realizes that the family is shown as creative of needs, that satisfies simultaneously with the State and the private sector. The research also shows that there are tools to protect the family that respond to specific problems, as an example, some refer to the protection of the right to family reunification and other to the protection of women and children in the family context. Finally, in respect to protection of women and children in the family context, the first is studied about additional problems that underscore their unequal status and greatest vulnerability. And in respect to children, the protection recognized needs to enable them to manage themselves responsibly, but the liberalization of divorce conditions and increased controls on parent-child relationships in families posdivorce can have negative consequences for children.
