El Derecho Internacional Humanitario (DIH) brinda una protección general al niño y a la niña en situación de conflicto armado por ser personas civiles que no participan en las hostilidades. Asimismo, el DIH brinda una protección especial por su edad y su particular vulnerabilidad. En este marco, la persona menor de 18 años no debe ser reclutada por las fuerzas armadas o por los grupos armados, y tampoco debe participar en las hostilidades. No obstante, la mayoría de normas del DIH fija como límite inferior la edad de 15 años. Concretamente, el DIH indica que, por un lado, los niños y las niñas reclutados y que participan en las hostilidades gozan del estatuto jurídico de combatiente y se benefician, en caso de captura, del estatuto de prisioneros de guerra; y por otro lado, aquellos que participan en la hostilidad, sin ser combatientes conforme al DIH, están sometidos a la legislación nacional del país al que pertenecen, y en caso de captura, se encuentran incluidos en la categoría de personas civiles. Además, el DIH sostiene que si el niño y la niña que han participado en las hostilidades no tienen derecho a un estatuto particular, de conformidad con el párrafo 3 del artículo 45 del Protocolo I, debe mínimamente beneficiarse de la protección general reconocida en su artículo 75.The International Humanitarian Law (IHL) provides general protection to children in armed conflicts for being civilians who do not participate in hostilities. Moreover, IHL provides special protection for their age and their particular vulnerability. In this framework, a person under 18 years old must not be recruited by the armed forces or armed groups, and neither should participate in hostilities. Nevertheless the majority of IHL rules fix the age of 15 years as the lowest limit. The IHL in particular indicates that, on one hand, the child enrolled and which participates in hostilities has the legal status of combatant and benefits, in case of capture, of the status of prisoner of war. On the other hand, the child who participates in hostility without being combatant under IHL is subjected to the national legislation of the country which is subject, and in case of capture, the child is included in the category of person protected by the Fourth Convention. In addition, IHL argues that if the child who has participated in hostilities is not entitled to a particular status in accordance to paragraph 3 of Article 45 of Protocol I, the person must be minimally benefit of the general protection conferred by Article 75 of the same instrument.
