When embedded in the law, these stereotypes perpetuate and even exacerbate inequality between men and women, particularly hindering the enjoyment and exercise of women's rights. Utilizing the hermeneutic method, we interpret and understand the concepts of gender, legal asymmetry, the constitutional principle of equality and non-discrimination, and their relationship with judicial practice. This work identifies the relationship between legal gender asymmetry and gender stereotypes, generating an interesting debate on the meaning of various rulings by the Supreme Court of Justice of the Nation and how these contribute to the realization of formal and material equality between men and women. El objetivo de este trabajo es analizar la tendencia del poder público en México a integrar al ordenamiento jurídico y a la práctica judicial, estereotipos de género arraigados en la sociedad mexicana que al ser plasmados en el derecho provocan que persista y hasta se incremente la desigualdad entre el hombre y la mujer, y en particular, impidan el goce y disfrute de los derechos de la mujer. Con el auxilio del método hermenéutico, realizamos la interpretación y comprensión de los conceptos de género, asimetría jurídica, principio constitucional de igualdad y no discriminación, y la relación que estos tienen con la práctica judicial. El resultado de este trabajo es la identificación de la relación entre la asimetría jurídica de género y los estereotipos de género, lo que genera un interesante debate sobre el sentido de distintas sentencias de la Suprema Corte de Justicia de la Nación, y cómo estas contribuyen a la realización de la igualdad formal y material entre el hombre y la mujer. O objetivo deste trabalho é analisar a tendência do poder público no México de integrar ao ordenamento jurídico e à prática judicial estereótipos de gênero arraigados na sociedade mexicana, que, ao serem incorporados ao direito, provocam a persistência e até o aumento da desigualdade entre homens e mulheres, impedindo, em particular, o gozo e usufruto dos direitos das mulheres. Com o auxílio do método hermenêutico, realizamos a interpretação e compreensão dos conceitos de gênero, assimetria jurídica, princípio constitucional de igualdade e não discriminação, e a relação que esses têm com a prática judicial. O resultado deste trabalho é a identificação da relação entre a assimetria jurídica de gênero e os estereótipos de gênero, gerando um interessante debate sobre o sentido de diversas sentenças da Suprema Corte de Justiça da Nação e como estas contribuem para a realização da igualdade formal e material entre homens e mulheres.
