The resolution, led by Costa Rica on behalf of a group of proponent countries, constitutes a historic milestone that will strengthen the inescapable link between human rights and the environment, in addition to supporting the creation of minimum standards of protection for all people in all regions of the world. The right to a clean, healthy and sustainable environment is the continuation of a process that began with the adoption of the Stockholm Declaration of 1972 and continued with the approval of the Rio Declaration of 1992. Despite being recognized in 155 legal different legal systems, this right has had to be studied linked to others rights such as life or health, and not as a right on its own, due to the lack of consideration at the international level. It is possible that in the coming months we will witness recognition in other forums, due to the context of environmental and biodiversity crisis in which we live, and the current concern about the effects of climate change on life on the planet, as well as on the full enjoyment of human rights. This article aims to share with readers the general context and some details of the negotiations in Geneva. El 8 de octubre de 2021, el Consejo de Derechos Humanos de las Naciones Unidas aprobó una resolución que reconoce, por primera vez a nivel internacional, el derecho humano a un ambiente limpio, saludable y sostenible. La resolución, liderada por Costa Rica en nombre de un grupo de países proponentes, constituye un hito histórico que afianzará el vínculo ineludible entre derechos humanos y ambiente, además de apoyar la creación de estándares mínimos de protección para todas las personas en todas las regiones del mundo. El derecho a un ambiente limpio, saludable y sostenible es la continuación de un proceso que empezó con la adopción de la Declaración de Estocolmo de 1972 y que continuó con la aprobación de la Declaración de Río de 1992. A pesar de ser reconocido en 155 ordenamientos jurídicos diferentes, dicho derecho se ha tenido que estudiar ligado a otros como la vida o la salud, y no como un derecho con vida propia, a falta de consideración a nivel internacional. Es posible que en los próximos meses seamos testigos del reconocimiento en otros foros, debido al contexto de crisis ambiental y de biodiversidad en el que vivimos, y a la preocupación actual sobre los efectos del cambio climático sobre la vida en el planeta, así como en el disfrute pleno de los derechos humanos. El presente artículo pretende compartir con las personas lectoras el contexto general y algunos detalles de las negociaciones en Ginebra. Em 8 de outubro de 2021, o Conselho de Direitos Humanos das Nações Unidas aprovou uma resolução reconhecendo, pela primeira vez em nível internacional, o direito humano a um meio ambiente limpo, saudável e sustentável. A resolução, liderada pela Costa Rica em nome de um grupo de países proponentes, constitui um marco histórico que fortalecerá o vínculo incontornável entre direitos humanos e meio ambiente, além de apoiar a criação de padrões mínimos de proteção para todas as pessoas em todas as regiões do mundo. O direito a um meio ambiente limpo, saudável e sustentável é a continuação de um processo que começou com a adoção da Declaração de Estocolmo de 1972 e continuou com a aprovação da Declaração do Rio de 1992. Apesar de ser reconhecido em 155 ordenamentos jurídicos diferentes, este direito teve que ser estudado vinculado a outros como a vida ou a saúde, e não como um direito com a própria vida, por falta de consideração no âmbito internacional.
