In this article we will address some of the obstacles that women face when coming into contact with the criminal justice system, whether as defendants or as victims. Then, we will define if the expansion of the repressive apparatus is a response consistent with the international obligations of protection and promotion of women’s rights, or if said response, on the contrary, ends up maintaining a social status quo in which gender hierarchies and stereotypes continue to exist and reproduce. The conclusion will go in the latter sense and will require the State to implement effective public policies and a transversal gender perspective at all state levels. En el presente artículo abordaremos algunos de los obstáculos que enfrentan las mujeres al entrar en contacto con el sistema de justicia penal, ya sea en el lugar de imputadas o de víctimas. Luego, definiremos si la ampliación del aparato represivo es una respuesta concordante con las obligaciones internacionales de protección y promoción de los derechos de las mujeres, o si dicha respuesta, por el contrario, termina manteniendo un statu quo social, en el cual siguen existiendo y reproduciéndose jerarquías y estereotipos de género. La conclusión irá en este último sentido y exigirá al Estado la implementación de políticas públicas efectivas y de una perspectiva de género transversal a todos los ámbitos estaduales. Neste artigo abordaremos alguns dos obstáculos que as mulheres enfrentam ao entrar em contato com o sistema de justiça criminal, seja como rés ou como vítimas. Em seguida, definiremos se a ampliação do aparelho repressivo é uma resposta condizente com as obrigações internacionais de proteção e promoção dos direitos das mulheres, ou se tal resposta, ao contrário, acaba por manter um status quo social, em que continuam a existem e reproduzem hierarquias e estereótipos de gênero. A conclusão será neste último sentido e exigirá que o Estado implemente políticas públicas efetivas e uma perspectiva transversal de gênero em todos os níveis estaduais.
