To do this, the paper adopts the advances of a recent field of research exploring the relation between literature and human rights, and discusses their possibilities for the case of Latin American literature. Through the analysis of four novels, belonging to the social criticism narrative in the middle of the twentieth century, the article shows the way in which the literary discourse has been involved in the promotion and expansion of human rights, and in the defense of new subjects of rights. When studying the way in which these fictions build arguments in favor of the expansion of the political space and of a more equitable reorganization of the national community, the article dares to contribute to a better understanding of both the way in which human rights are integrated and consolidated in other discourses, and the key role that literature claimed to have in the construction of a democratic ethics in the Latin American national states. Siguiendo la propuesta teórica de Amartya Sen de considerar los derechos humanos como demandas de carácter ético capaces de articular un tipo particular de reciprocidad moral, el artículo se propone profundizar en la idea de los derechos humanos como artefactos culturales inseparables de la esfera pública y de sus lógicas de creación y legitimación de identidades sociales y políticas. Para ello, retoma los avances de un campo reciente de investigación que indaga las relaciones entre la literatura y los derechos humanos y discute luego sus posibilidades para el caso de la literatura latinoamericana. A través del análisis de cuatro novelas, pertenecientes a la narrativa de denuncia social de mitades del siglo XX, el artículo muestra la forma en que el discurso literario ha estado involucrado en la promoción y expansión de los derechos humanos y en la defensa de nuevos sujetos de derechos. Al estudiar la manera en que estas ficciones construyen argumentos a favor de la ampliación del espacio político y de una reorganización más equitativa de la comunidad nacional, el artículo apuesta a contribuir a una mejor comprensión, tanto de la forma en que los derechos humanos se integran y afianzan en otros discursos, como del papel clave que la literatura pretendió tener en la construcción de una ética democrática en los Estados nacionales latinoamericanos. Seguindo a proposta teórica de Amartya Sen que considera os direitos humanos como exigência ética capaz de articular um tipo particular de reciprocidade moral, o artigo pretende aprofundar a ideia dos direitos humanos como artefatos culturais inseparáveis da esfera pública e de sua lógica criadora e legitimadora das identidades sociais e políticas. Para isso, resgata os avanços de um recente campo de pesquisa, que explora a relação entre a literatura e os direitos humanos e, em seguida, discute o seu potencial para o caso da literatura latino-americana. Através da análise de quatro romances, pertencente à narrativa de denúncia social da metade do século XX, o artigo mostra como o formato de discurso literário há estado relacionado com a promoção e expansão dos direitos humanos, e na defesa dos novos sujeitos de direitos. Ao estudar como estas ficções elaboram argumentos a favor da expansão do espaço político e de uma reorganização mais equitativa da comunidade nacional, o artigo pretende contribuir na melhora da compreensão tanto da forma com que os direitos humanos se integram e confiam em outros discursos, como o papel fundamental que a literatura pretendeu ter na construção de uma ética democrática nos estados nacionais latino-americanos.
