Its purpose is to provide a discussion on a current legal and institutional reality, that is, the right to education in human rights based on one of the most important constitutional reforms in recent years in the field of human rights: the reform of June 2011. This reform, by the article 1° and 3° of the Constitution, introduced a public policy (proposed to the National Development Plan 2013-2018, along with the National Human Rights Program 2014-2018 within the federal public administration) whose object is to implement the teaching of human rights at the national level. In this proposal, we observe two effects, one positive and one negative, inscribed only in the institutional or official dimension of the Mexican State, from which is derived a third positive effect for the social or local sphere, that is to say, for the space where the popular sectors or cultural minorities live. Therefore, it is in this social or local sphere where the third positive effect of the national public policy would take place to rethink the counter-hegemonic and alternative use of the right to education in human rights, from where would be possible the social-local construction or reconstruction of human rights that the present and future society requires with some urgency. El presente trabajo constituye una reflexión crítica desde el ámbito jurídico-social de los derechos humanos en México, cuyo fin es poner a discusión a partir de una realidad jurídica e institucional presente, el tema del derecho a la educación en derechos humanos a partir de una de las reformas constitucionales más importantes en los últimos años en materia de derechos humanos, la de junio de 2011, donde a partir de los artículos 1° y 3° constitucionales se derivó una política pública propuesta en el Plan Nacional de Desarrollo (PND) 2013-2018 a la par con el Programa Nacional de Derechos Humanos (PNDH) 2014-2018 dentro de la administración pública federal, cuyo objeto es la implementación de la enseñanza de los derechos humanos en el ámbito nacional. En dicha propuesta observamos dos efectos, uno positivo y otro negativo inscritos en la dimensión meramente institucional u oficial del Estado mexicano, de los cuales se deriva un tercer efecto positivo para el ámbito social o local, es decir, en el espacio donde se encuentran los sectores populares o minorías culturales; por lo tanto, es en este espacio social o local, donde el tercer efecto positivo de la política pública nacional cobraría lugar para repensar el uso contrahegemónico y alternativo del derecho a la educación en derechos humanos, desde donde sería posible la construcción o reconstrucción social-local de los derechos humanos que la sociedad presente y futura requiere con cierta urgencia. Este trabalho é uma reflexão crítica, desde o campo jurídico-social dos direitos humanos no México, cujo objetivo é realizar uma discussão partindo de uma realidade jurídica e institucional presente:  a questão do direito à educação em Direitos Humanos, a partir de uma das mais importantes reformas constitucionais nos últimos anos, sobre os direitos humanos.  Esta foi em junho de 2011, onde, a partir dos artigos constitucionais 1º   e 3º, teve como resultado a política pública proposta no Plano Nacional de Desenvolvimento 2013-2018, seguido do Programa Nacional de Direitos Humanos 2014-2018, no âmbito administrativo do governo federal, que visa implementar o ensino dos direitos humanos a nível nacional. Nesta proposta, observamos dois efeitos, um positivo e outro negativo, registrado na dimensão puramente institucional ou oficial do Estado Mexicano, das quais deriva um terceiro efeito para a dimensão social ou local; em outras palavras, no espaço  onde o setores populares ou minorias culturais estão presentes; portanto, é neste espaço social ou local  que o terceiro efeito  teria o  impacto positivo da política pública nacional. Este seria um lugar para repensar o uso contra hegemônico e alternativo do direito a educação em Direitos Humanos, onde fosse possível a construção ou reconstrução social-local dos direitos humanos que a sociedade presente e futura requer com uma certa urgência.
