It is delivered by the public sector in conjunction with the private sector, in which case the State, through the Ministry of Education, Science, and Technology, acts as the regulatory body for the service. This bibliographic research aims to determine whether, in any of the service delivery modalities, the State, through the Ministry of Education, Science, and Technology, and other public entities involved in the public education service, fulfill the duty of good administration, which is also seen as a guiding principle of administrative activity and as a right of citizens. La educación, derecho humano fundamental de todas las personas; es atendida por medio de la organización y funcionamiento del servicio público esencial de educación; es prestado por el sector público en concurrencia con el privado, en este último caso, el Estado, por medio del Ministerio de Educación, Ciencia y Tecnología se convierte en el ente regulador del servicio. Se pretende mostrar en esta investigación bibliográfica, si en cualquiera de las modalidades de la prestación, el Estado, por medio del Ministerio de Educación, ciencia y tecnología y demás entes públicos involucrados en el servicio público de educación, cumplen el deber de la buena administración, que además es vista como principio rector de la actividad administrativa, y como derecho de los ciudadanos.
