In particular, the control and proper management of conflict and litigation. The research was carried out through an eminently theoretical approach based on documents. The findings determine that, although the CPCM has several interesting points for the civil justice reform process in Latin America, procedural legality seems to be a point to review or discuss given the rigidity with which it has been conceived and the contradictions it shows. These factors make it difficult to introduce the necessary legal tools for a better treatment of cases. Among them, the idea of flexible and dynamic resolution mechanisms, case management and organizational transformation and its management model. El artículo analiza cómo se recepta la legalidad procesal en el Código Procesal Civil y Mercantil de El Salvador, a fin de problematizar y presentar posibles relecturas del mismo que permitan potenciar la realización de los objetivos centrales del sistema de justicia. En particular, el control y gestión adecuada del conflicto y la litigación. La investigación fue realizada a través de un abordaje eminentemente teórico de base documental. Los hallazgos determinan que, si bien el CPCM tiene diversos puntos interesantes para el proceso de reforma a la justicia civil en Latinoamérica, la legalidad procesal pareciese ser un punto a revisar o discutir dada la rigidez con que ha sido concebida y las contradicciones que evidencia. Dichos factores dificultan la introducción de herramientas legales necesarias para un mejor tratamiento de los casos. Entre ellas, la idea de mecanismos de resolución flexibles y dinámicos, el case management y la transformación organizacional y su modelo de gestión.
