Therefore, the problem is presented in its historical, economic and social context or from an epistemological approach and understanding. A rediscovery or resignification of this concept is sought, which implies a migration in the way of seeing the matter; from a proactive position and a look or reasoning that concentrating the individual freedoms, the formalism and the rigidity of the institutions and the absolutism of the rights towards a socializing look and oriented to the search of moral limits in contractual relationships. El concepto de justicia contractual ha sido mirado de distintas formas en la historia, ya que el derecho es sin duda un fenómeno de control social y el contrato es un instrumento de control económico dentro de la estructura social, por ello, se presenta el problema en su contexto histórico, económico y social o desde una aproximación y comprensión epistemológica. Se busca un redescubrimiento o resignificación de este concepto, lo que implica una migración en la forma de ver el asunto; desde una posición voluntarista y de una mirada o de razonamientos que privilegiaban las libertades individuales, el formalismo y la rigidez de las instituciones y el absolutismo de los derechos, hacia una mirada socializadora y orientada a la búsqueda de límites morales en las relaciones contractuales.
