Parte I Landaverde Hernández, Moris Edgardo Pena de Prisión Finalidades de la Pena Sistema Progresivo Sistema y Beneficios Penitenciarios Derecho a la Resocialización Prison sentence Purposes of the penalty Progressive system System and prison benefits Right to resocialization Inside criminal discipline have established specific theories studying the penalty as the main legal consequence of crime that are currently the subject of discussion. In the Salvadoran legal field, the Constitution according its article 27 paragraph 3, regulates the principle of resocialization, which tends its effects to the penitentiary environment interpreted by more than one as the constitutional establishment of the Special preventive purposes of penalty. Notwithstanding the above, the generalpreventive purposes are always fitted in Salvadorian legal order. This has caused some tension between both purposes at the time of the criminal commination through legislative reform, the application of the rule with the respective sentence or the penal execution through the enforcement of the penalty, which has not always been balance, but that has private one at the expense of the other. Al interior de la disciplina penal se han instaurados teorías concretas que estudian la pena como principal consecuencia jurídica del delito, mismas que actualmente, son objeto de discusión. En el ámbito jurídico salvadoreño, ha sido la Constitución que en su Art. 27 inc 3°, regula el principio de resocialización, que tiende sus efectos al ámbito penitenciario, interpretado por más de alguno, como la instauración constitucional de las finalidades preventivas especiales de la pena. No obstante, lo anterior, las finalidades preventivo generales encuentran siempre cabida en orden jurídico salvadoreño. Lo anterior, ha ocasionado cierta tensión entre ambas finalidades a la hora de la conminación penal a través de la reforma legislativa, la aplicación de la norma con la respectiva sentencia o la ejecución penal mediante el cumplimiento de la pena, en las cuales no siempre ha existido equilibrio, sino que ha privado una en detrimento de la otra.
