Consequently, this universal principle of law operates as a criterion for the solution of normative antinomies or contradictions. For this reason, some general aspects of antinomies are developed, such as their definition, requirements, identification criteria, classes of antinomies and the rules or criteria for their solution. But the interest of this paper is to discover how the Administrative Procedures Law (LPA) treats this principle and the possible antinomies that may arise from the entry into force of the former. The main finding is that the LPA establishes a “Preventive Regime of Double-Sided Antinomies”: On the one hand, as a general rule, it establishes the express derogation, nominative or innominate, of previous laws or special rules that contradict the LPA; and, on the other hand, as an exception, it imposes the express prevalence of certain special rules. This regime is complemented by the “Mandate for the Correction of Antinomies with Prevalence of the LPA”, established in its article 166, which obliges state institutions to adapt to the LPA the norms of any nature that regulate the different administrative procedures that may be incompatible with the provisions of said law. Es un estudio sobre el principio de especialidad, según el cual, en los casos de contradicción entre una norma especial previa y una norma general posterior, prevalece la primera. En consecuencia, este principio universal del Derecho opera como un criterio de solución de antinomias o contradicciones normativas. Por esta razón, se desarrollan algunos aspectos generales de las antinomias como son su definición, requisitos, criterios de identificación, las clases de antinomias y las reglas o criterios de solución de las mismas. Pero el interés de este trabajo es descubrir cuál es el tratamiento que la Ley de Procedimientos Administrativos (LPA), regula acerca de este principio y sobre las posibles antinomias que surjan a partir de la entrada en vigencia de la primera. El principal hallazgo es que la LPA establece un “Régimen Preventivo de Antinomias de Doble Vertiente”: Por un lado, como regla general, establece la derogatoria expresa, nominada o innominada, de leyes o normas especiales previas que contradigan a la LPA; y, por otro lado, como excepción, se impone la prevalencia expresa de determinadas normas especiales. Este régimen se complementa con el “Mandato de Subsanación de Antinomias con Prevalencia de la LPA”, establecido en su art. 166, que obliga a las instituciones estatales a adecuar a la LPA las normas de cualquier naturaleza que reglamenten los distintos procedimientos administrativos que pudieren ser incompatibles con lo previsto en dicha ley.
