Both on the part of the legal operator, when presenting the case, to cite it, when it is favorable to the rights he defends; and on the part of the Magistrate to resolve it and apply it to the sentence he issues. However, this application of the precedent is made from a retrospective view of the institute, however, if it is applied with a prospective view, oriented to create new paths, without underestimating the existing ones or those already traveled, the future precedent will then depend more on what is done today, than what was done in the past. For this, it must be known who ultimately generates the precedents or how to change them. Because today’s case may become tomorrow’s precedent. Is it only the Judges who create precedents? Or, Are there other legal operators, particularly lawyers, also involved in their creation? The latter are the legal professionals who set the judicial machine in motion when they file their lawsuit; therefore, they are not reduced to mere spectators, but to litigants who activate the justice administration system. Los precedentes judiciales son fuente de creación del derecho, por lo tanto, es necesario su divulgación y conocimiento. Tanto por parte del operador jurídico, al plantear el caso, para citarlo, cuando le es favorable a los derechos que defiende; como por parte del Magistrado para resolverlo y aplicarlo a la sentencia que dicta. Sin embargo esta aplicación del precedente se realiza desde una mirada retrospectiva del instituto, ahora bien, si se aplica con mirada prospectiva, orientada a crear nuevos caminos, sin menospreciar los existentes o los ya transitados, el futuro precedente entonces, dependerá más de lo que se haga en el hoy, que lo que se hizo en el pasado. Para ello, debe conocerse quién es en definitiva el que genera los precedentes o ¿cómo hacer para su cambio? Ya que el caso de hoy, se puede convertir en el precedente del mañana. Puede cuestionarse ¿son sólo los Jueces quienes originan los precedentes? Ò ¿también forman parte de su creación otros operadores jurídicos y en particular los abogados? Estos últimos son los profesionales del derecho que ponen en movimiento la máquina judicial cuando interponen su demanda; por lo que no se reducen a meros espectadores, sino en litigantes que activan el sistema de administración de justicia.
