En la búsqueda de equilibrar las relaciones jurídicas contractuales entre las partes, en Europa y parte del mundo antiguo, se gesta desde el año 2015, una nueva doctrina que consiste en introducir mecanismos que pongan en un estado de igualdad a las partes que están dentro de un contrato, tratando de limitar el derecho de la autonomía de la voluntad y potenciar los Derechos Fundamentales de las personas para generar una relación donde no se aprovechen de las desventajas o falta de conocimiento o educación de la parte más débil. El artículo que se presenta está dividido de tal manera que el lector pueda determinar con claridad los desafíos que se tiene para moralizar el derecho privado salvadoreño vigente.
