description El presente trabajo tiene como propósito analizar el fenómeno de la concordancia de la información registral con la realidad extra registral en lo relacionado a los terrenos de la Comunidad Indígena de Matagalpa en el período 2010-2016. Para asegurar la obtención de datos de información fiables, veraces y objetivos, se utilizaron entrevistas dirigidas a los diferentes actores que tienen incidencias y participación activa en la problemática estudiada, encuesta a la población indígena y una investigación documental en la que se incluyó no solo datos bibliográficos, si no también resoluciones judiciales y administrativas referidas al fenómeno estudiado. Se verificó, que existe un buen grado de conocimiento de las leyes regulatorias por parte de las autoridades judiciales y registrales y los abogados y notarios. No así por parte de la población indígena y sus representantes. En cuanto a la aplicación de las leyes estudiadas, se observó que su aplicación es deficiente e incompleta debido en parte a que muchas de ellas son anacrónicas y no forman un cuerpo normativo. Se constató también que es un hecho, que la doble inmatriculación registral es persistente y fuente de muchos conflictos de propiedad, teniendo como consecuencia lógica la inseguridad jurídica de las transacciones inmobiliarias sobre terrenos de la comunidad indígena de Matagalpa. Por último, se verificó, que la actividad económica, relacionado a los terrenos comuneros, tiene dificultad en desarrollarse plenamente, ya que las instituciones financieras limitan el otorgamiento de créditos, cuando las garantías que se ofrecen están relacionadas a dichos terrenos.

To ensure reliable, truthful and objective information, interviews were used, aimed at the different actors that have incidents and active participation in the studied problem, a survey of the indigenous population and a documentary investigation that included not only data bibliographic, if not also judicial and administrative resolutions referring to the phenomenon studied. It was verified that there is a good degree of knowledge of the regulatory laws by the judicial and registry authorities and the lawyers and notaries. Not so on the part of the indigenous population and their representatives. Regarding the application of the laws studied, it was observed that their application is deficient and incomplete due in part to the fact that many of them are anachronistic and do not form a normative body. It was also found that it is a fact that the double registration is persistent and the source of many property conflicts, having as a logical consequence the legal insecurity of real estate transactions on land belonging to the indigenous community of Matagalpa. Finally, it was verified that economic activity, related to common land, has difficulty in fully developing, since financial institutions limit the granting of credits, when the guarantees offered are related to these lands.
