spelling RDMCP626272024-11-04T20:43:24Z EXCUSE OF ACQUITTAL FOR ACTIVE BRIBERY IN PERU: A REGULATORY STRATEGY EXCUSA ABSOLUTORIA PARA EL COHECHADOR ACTIVO EN EL PERÚ: UNA ESTRATEGIA NORMATIVA Palomino Martinez , Rolando Gonzales del Valle Tenorio, Sheyla Mayhua Quispe, Luis The purpose of this article is to analyze the acquittal excuse as a normative regulatory strategy that prioritizes the criminal prosecution of officials over individuals in the crime of bribery; Therefore, the study adopts a qualitative methodological approach, of a descriptive-explanatory type, with a documentary design, allowing for the systematic analysis of the bibliography linked to the research topic. In Peru, corruption is the main criminal problem in the country, since there is regulatory inefficiency and absence of strategic regulation to avoid discouraging individuals from reporting cases of corruption. Added to this panorama is the disadvantage of the clandestine nature of the criminal offense. called bribery, which does not make it possible to know real figures of its attendance because the third party outside the public service prefers to keep its actions hidden for fear of facing criminal justice, also hiding the illicit consummated by the official who accepts the bribe. El presente artículo tiene como objeto analizar la excusa absolutoria como estrategia normativa regulatoria que prioriza la persecución penal de los funcionarios sobre los particulares en el delito de cohecho; por lo tanto, el estudio adopta el enfoque metodológico cualitativo, de tipo descriptivo-explicativo, con diseño documental, permitiendo analizar sistemáticamente la bibliografía vinculado al tema de investigación. En el Perú la corrupción es el principal problema criminal del país, ya que existe ineficacia normativa y ausencia de regulación estratégica para no desincentivar a los individuos a denunciar los casos de corrupción, a este panorama se añade el inconveniente de la naturaleza clandestina del ilícito penal denominado cohecho, que no hace posible conocer cifras reales de su concurrencia debido a que el tercero ajeno a la función pública prefiere mantener oculto sus acciones por temor de enfrentarse a la justicia penal, ocultando también el ilícito consumado por el funcionario que acepta el soborno.
