A PROPÓSITO DEL CASO DE SREBRENICA Jiménez Solano, Francisco This article aims to examine the crime of genocide, starting with a brief review on the historical and dogmatic background, the forms of crime and the scope in which the norm seeks to offer certain level of protection. Afterwards, the article analyzes the criminal Code regulation about genocide, comparing it with International Law. Evidently, the national regulation is deficient, incoherent with the rest of the criminal system regarding the severity of the punishment, and inapplicable, especially considering legality and the prohibition of analogical interpretation of the law. Furthermore, the norm faces problems concerning superior responsibility and fault-based liability. When reviewing the International Criminal Tribunal for the former Yugoslavia legal precedents, regarding the Srebrenica genocide, the investigation concludes that the doctrine developed by the Court cannot solve the flaws of the national regulation on genocide. It is true, however, that certain parts of it can be applied with no major issue, such as the Joint Criminal Enterprise doctrine. Nevertheless, only a proper legal reform can solve the issues presented in this article. Even when facing the most gruesome crimes against humanity, the strict observance of the general principles of Criminal Law cannot be overlooked, especially considering that International Law itself has already drawn clear lines on how to prosecute genocide. Este artículo busca analizar el delito de genocidio, iniciando por un repaso general sobre su desarrollo histórico y dogmático, sus modalidades de comisión y el ámbito de protección de una especie delictiva especialmente compleja. Posteriormente, se examina la regulación sobre el genocidio, contenida en el Código Penal costarricense, y se contrasta con las disposiciones internacionales, determinándose que la figura nacional es deficiente en su formulación, incoherente con el resto del ordenamiento jurídico en su penalidad y, finalmente, inaplicable en un nivel práctico, si se respetan los principios de legalidad y prohibición de analogía. Además, se plantean problemas en cuanto a la responsabilidad del superior de naturaleza culposa y a la responsabilidad por omisión. Se procede entonces a revisar las líneas jurisprudenciales generales trazadas por el Tribunal Penal Internacional para la ex Yugoslavia, en los casos asociados al genocidio de Srebrenica, con la finalidad de determinar si este desarrollo permite solventar las lagunas existentes en la legislación nacional. Si bien podría utilizarse una figura como la de la Empresa Criminal Conjunta (JCE) para acreditar un dominio común del hecho, solo una reforma legislativa, se concluye, podría solucionar los problemas de tipicidad objetiva y subjetiva existentes, pues ni siquiera en los casos de los crímenes más groseros contra la humanidad, puede negociarse el respeto a los principios protectores del Derecho Penal, máxime cuando el propio Derecho Internacional ha marcado la pauta sobre cómo debe tipificarse el genocidio.
