To do so, it is necessary to resort to the history and evolution of these rights, and the present work aims to contribute to an efficient productive debate about the nature of human rights, so that citizens can decide on the understanding that this is a thoughtful democratic and humanistic founded decision. The analysis is in the actual technical-ideological republican system which correspond to the current state of international law En la formación de una nueva Carta Fundamental los constituyentes requerirán conocer o consensuar sobre la naturaleza de los derechos humanos; luego, determinar cómo el Estado hará efectivo el respeto de tales derechos. Para ello es necesario recurrir a la historia y evolución de estos derechos, y el presente trabajo trata de contribuir a un debate productivo eficiente sobre la naturaleza de los derechos humanos, para que los ciudadanos puedan decidir en el entendido de que se trata de una decisión democrática reflexionada y fundada en el humanismo. El análisis se sitúa en el contexto técnico-ideológico del sistema republicano vigente que corresponde al estado actual del derecho internacional.
