DERECHO22652024-06-07T16:14:27Z Reflexive apology: dogmatic and probative problems in sexual crimes Apología reflexiva: Problemas dogmáticos y probatorios en delitos sexuales Villedas Soto, Miguel Alejandro Delito sexual sujeto activo víctima bien jurídico protegido Sexual crime active subject victim protected legal right This academic article, part of revealing the dogmatic and evidentiary problems present in the crimes of Rape and Sexual Assault, for this reason, two interpretive scales are created: i) General typical dimension, when the victim is over sixteen years of age and has no mental disability; and ii) Qualified typical dimension, which comes from the mentally alienated victim or when it’s less than or equal to fifteen years of age; by virtue that, the Salvadoran legal-criminal reality, requires improving the questions and reflections for the best judicialization of criminal cases. In this context, there are two objectives that have guided the study. The first of them, to systematize and order the criminal types and the legal rights they protect. The second, from that structure, is to unfold the problems inherent in the judgment of typicality and guilt, as well as the probative disadvantage they require. In order to achieve its objectives, the text uses a qualitative method and adopts an applied research model, because it derives from the usual problems present in the sentencing stage of criminal proceedings in El Salvador, in turn, takes up aspects of bibliographic research, derived from the approach of Salvadoran jurisprudence in criminal matters. From the full study of the article, a better understanding of the existence of three legal assets, a clear approach to the problem arising from circumstances such as the consent of the minor in sexual relations and the role of the victim in the evidentiary activity will be obtained. Este artículo académico parte de revelar los problemas dogmáticos y probatorios presentes en los delitos de violación y agresión sexual, por ello, se crean dos baremos interpretativos: i) dimensión típica general, cuando la víctima supera los dieciséis años de edad y no tiene incapacidad mental; y ii) dimensión típica cualificada, que proceden en la víctima enajenada mental o cuando es menor o igual a quince años de edad; en virtud, que la realidad jurídico-penal salvadoreña, exige mejorar los cuestionamientos y reflexiones para la mejor judicialización de casos penales. En este contexto, dos son los objetivos que han dirigido el estudio. El primero de ellos, sistematizar y ordenar los tipos penales y los bienes jurídicos que protegen. El segundo, a partir de esa estructura, desplegar los problemas que habitan en el juicio de tipicidad y en el de culpabilidad, así como, la desventaja probatoria que requieren. Con el afán de encaminarse hacia los objetivos planteados, el texto utiliza un método cualitativo y adopta un modelo de investigación aplicada, porque deriva de los problemas habituales presentes en la etapa de sentencia de procesos penales en El Salvador, a su vez, retoma aspectos de la investigación bibliográfica, derivada del enfoque de la jurisprudencia salvadoreña en materia penal. Del estudio íntegro del artículo, se obtendrá una mayor comprensión sobre la existencia de tres bienes jurídicos, un claro enfoque del problema derivado de circunstancias como el consentimiento del menor de edad en las relaciones sexuales y la función de la víctima en la actividad probatoria.
